Seller: Atina Auction House LLC is the acting agent between you and the seller. ( Hereafter to be referred to as the: Seller, Consignor ). The seller's identity may be undisclosed. Atina Auction House LLC 's staff ( Hereafter to be referred to as the: staff, employees). An auction Lot ( hereafter to be referred to as the: Lot, lots, item, Merchandise). BUY-NOW lot ( Hereafter to be referred to as BUY - NOW ) 1. Descriptions of lots, and catalog, private reserve. (a) All bids are by lot as numbered in the catalog the buyer is responsible to know what item you are bidding on. Catalog descriptions are only a statement of opinion. Atina Auction House LLC makes no independent warranty or guarantee of any kind to the merchandise or property nor shall we, nor our staff, nor our seller/s be held responsible, or to have made any representation or warranty for works of art, furniture, fine art, correctness, genuineness, provenance, origin, manufacture, composition, period, culture, source, authorship, attribution, authenticity, description, rarity, importance, literature,historical importance or value, or condition of the merchandise, or guarantee or assume any liability of any kind in respect of any lot with regard to merchantability, fitness for a particular purpose. All lots are sold " As Is " unless as required by law any express or implied warranty of any kind whatsoever is excluded by the terms and conditions herein for this auction sale. (b) No statement made orally, by writing, or by telephone, cell/smartphone, cell/smartphone text prior, to, or during, or after the sale or in the bill of sale, invoice, or by Email or fax shall be deemed such a warranty of representation or assumption of liability. The buyer assumes all risk and liability for your bid and/or purchase/s made. (c) A lot may be subject to a private undisclosed reserve that may be agreed upon by us and our consignor. The reserve is an undisclosed confidential minimum agreed upon by us and the consignor. A representative or member of our staff appointed by us will be directed to execute the bidding on behalf of our consignor in the event that a lot is subject to a reserve. Atina Auction house LLC may reject any bid or raise a bid not commensurate with the value of the lot or cancel the sale at anytime prior to or after the drop of the hammer or closing of the lot in this Online Auction. Private undisclosed reserves between us and our consignors will not exceed the estimates of each lot that an undisclosed private reserve was agreed. (d)The auctioneer shall have sole discretion to refuse any bid, or refuse to acknowledge any bidder at any time during the auction. Atina Auction House LLC will be the sole arbiter in the case of any disputed bids. The high bidder will be the purchaser deemed solely by Atina Auction House LLC. Atina Auction House LLC may withdraw any lot or re-offer the lot for sale at any time at our sole discretion or to sell the lot in a future auction. 2. Condition report. (a) An absence of a condition report does not imply that a lot is in perfect condition or that the merchandise is free from wear and tear, or imperfections caused by age, use, restorations, repairs, or at the time of manufacture and or the creation. Condition reports by us are only our opinion. (b) A request for a condition report can be made via Email, or by phone. Any request for a condition report will be given as our opinion and should not be relied upon or construed as a statement of fact. All Dimensions, weights, and color are approximate and only our opinion. (c) We strongly encourage the bidder to view the item/s in person. Viewing is by appointment on the day of the sale. Bidders should make their appointment three (3) days before the sale date. (d) Lots are sold " as "is " in the condition they are in at the time and place of the sale and without any Guarantee or warranty, or assumption of liability of any kind whatsoever by Atina Auction House LLC, our staff, or consignor. 3. Registration and Registering to bid. (a) To bid or purchase a lot or Buy-NOW merchandise you must be 18 years of age or older. (b) Atina Auction House LLC may decline or permit you to register as a bidder at our sole discretion. Atina Auction House LLC may eject any bidder or not acknowledge any bidder in the sale for any reason at our sole discretion. (c) For lots with a $50,000.00 or more low estimate, Atina Auction House LLC may require a minimal deposit ten (10) days before the auction sale. Please contact us VIA Email if you plan to participate to bid on such lot/s. 4. Copyrights, reproduction rights, advertisements. (a)Atina Auction House LLC nor its staff, nor consignors make no warranty or representation, express or implied, that the purchaser will gain any copyright or reproduction rights to any lot purchased. Atina Auction House expressly reserves the right to reproduce any image of the lots sold in this catalog. (b)The copyright to all images, illustrations and written material produced by or for Atina Auction House LLC for a lot, the advertisement/s of, and including the contents of this catalog, is the property of Atina Auction House LLC and shall not be used by the purchaser, nor an associate of the purchaser, nor by anyone else, without prior written approval by us. 5. Payment, Tax, VAT, added Fees. (a) All purchases made in this ONLINE ONLY SALE to be paid for post 48 hours of receiving the invoice. Atina Auction House LLC accepts payments made by cash, bank issued check, personal check, money order, or bank wire transfer. We do not accept credit card nor do we accept debit card payment. When paying for your item by check or money order using a mail service the purchaser is required to send us confirmation by Email that the payment was sent the day of sending it to us. We accept payments in person by cash with a valid picture ID provided by the purchaser only. If paying by bank wire transfer ( buyer assumes the applicable fee cost for bank transfers on both ends if applicable by your bank, and/or our bank). Payment made by personal check will be accepted with a bank guarantee issued to us by your bank. (b) In person Cash payment and merchandise pick up. The purchaser will come in person to make payment by cash to provide a legal form of identification with your picture on it or will present a legal form of documentation that will satisfy Atina Auction House LLC (c) Atina Auction House LLC expressly reserves the right to hold all Merchandise until payment has been made full by the purchaser, including payment by check, or by money order. The purchaser is responsible for a $35.00 fee for any dishonored check payment. If a payment by check is dishonored the purchaser will contact Atina Auction House LLC for instructions to make payment by herein alternative payment method. (d)Atina Auction House LLC shall have no liability for any damage or loss to property left at our warehouse facilities after five (5) days of the close of the sale. All Merchandise shall be removed from our warehouse within twenty-one (21) days of the sale. (e)International buyers are responsible for all applicable tax, VAT, duty costs by their location. It is your responsibility to ascertain any documentation or applications needed and to pay actual fees and costs. This includes any documentation, applications, and licenses for transporting or shipping purchased merchandise within this online auction sale. (f) The purchaser is responsible for any and all applicable tax including the VAT. A 6.5% State Of Michigan sales tax fee will be added to the purchase cost and applied to your invoice unless the purchaser can provide the legal documentation that gives the purchaser, company, or entity a legal Tax exemption. It is the buyers' responsibility to ascertain and pay all applicable taxes due by law. Certain property sold at auction may be made of or contain materials that may be subject to laws governing export, import or interstate transportation this includes but not limited to materials. It is your responsibility to obtain any and all export, import and/or transport licenses, permits or documentation required by any authority. The denial or delay in obtaining any license or permit from any agency shall not justify the cancellation or rescission of any sale or any delay in making payment for the total purchase price of any lot in accordance with these Terms and conditions of this online auction sale. (g) Failure to pay by you for a , BUY-NOW , or any purchased merchandise , or breach of these terms and conditions which are binding to you in addition to the other remedies available to us by law, we reserve the right to impose a late charge of 1.5% per month of the total purchase price if payment is not made in accordance with the conditions set forth herein. If any of these terms and conditions herein are not complied with by the purchaser for non payment, dishonored payment,or any breach of these terms and conditions in addition to other remedies available to us and our consignor(s) by law, including without limitation the right to hold the purchaser liable for the total purchase price, including all costs of collection including attorneys fees, and disbursements that we, at our option, may either cancel the sale, retaining as liquidated damages all payments made by the purchaser or resell the property at public auction without reserve, and the purchaser will be liable for any deficiency, costs including handling charges, the expenses of both sales, our commission on both sales at our rate, all other charges due hereunder, and damages. In addition, a defaulting purchaser will be deemed to have granted us a security interest in, and we may retain as collateral security for such purchaser's obligations to us, any property in our possession, owned by such purchaser. We shall have all of the rights accorded a secured party under the State Of Michigan Uniform Commercial Code with respect to such property, and we may apply against such obligations all monies held or received by us for the account of, or due from us too, such purchaser. At our option, payment will not be deemed to have been made in full until we have collected funds represented by checks, money order, or in the case of bank transfer or cashiers check(s), we have confirmed their authenticity with the bank and/or the bank (s) confirm the payment(s)have been made full. 6. Mechanical, mechanized items, Watches, clocks, cameras, electronics, mobile and mixed media art. (a) We are not responsible to you for any reason to give any representation, warranty or guarantee, or assume any liability of any kind in respect of any lot with regard to any items that are mechanical , or mechanized including watches, or clocks, or cameras, or electrical, or electronics , or mobile, or mixed media artworks. (B) Atina Auction House LLC disclaims any liability whatsoever for accidents, injury, and damage resulting to any person from the storage or subsequent use of any such lots purchased. 7. Applicable law, venue of Jurisdiction. (a)These Conditions of Sale shall be governed by and construed, interpreted, applied and enforced in accordance with the domestic laws of the State of Michigan, in the county of Wayne. By participating in an auction subject to these Conditions of Sale, it is agreed that all parties (including but not limited to, Atina Auction House LLC, bidders, and purchasers) consent irrevocably and exclusively to a venue in Wayne County in the State of Michigan. (c) In no event of any kind will the liability of Atina Auction House LLC, nor our seller(s) to any purchaser, for any item, to exceed the purchase price actually paid by the purchaser. 8. Technical errors, and/or connectivity loss for this Online auction only sale. (a)Atina Auction House LLC will not be responsible to any bidder or purchaser for any error or loss of internet connection to make your bids on the internet, a mobile device or any internet system, or by landline telephone on your end or ours. 9. Shipping, In House Shipping, Merchandise pick up. (a)All merchandise must be paid for in full before being released to the purchaser or shipper. All Merchandise must be paid for in full within seven (7) days of the sale. All merchandise must be removed from our warehouse facility twenty-one (21) days from the day of the sale. (b) Atina Auction House LLC does not ship ( but not limited to ) furniture, mirrors, lamps, floor lamps, fine art, mixed media art, mobile art, clocks, large paintings, or large art sculptures. The buyer should contact us VIA Email prior to bidding on any lot if they plan to use in-house shipping (c) Atina Auction House offers in-house shipping only as a courtesy for the contingent United States Of America and only for a lot/s that do not exceed the measurement and weight limitations and/or restrictions packaged for USPS (United States Postal Service ) "ONLY". A handling fee plus shipping costs will be added to the invoice if the purchaser requests in-house shipping. A $10.00 fee for each lot "we do not combine lots"will be applied plus shipping cost, insurance, and tracking number costs to your final purchase cost. For in-house shipping "Packing materials used will be recycled". Atina Auction House LLC may cancel in-house shipping for any purchase for any reason at our sole discretion without liability. In the even we cancel in-house shipping the purchaser will hire their own shipper and/or delivery company to facilitate and expedite the removal and shipping of any and all merchandise immediately upon being notified by Email by us. All merchandise must be paid for in full before Atina Auction House LLC releases any purchased lot/s to the shipper. Atina Auction House LLC will not be responsible for any lost, damaged, stolen merchandise by the shipper. The Buyer assumes all responsibility to track your shipped merchandise and to address any issues in regards to shipping what-so-ever once your merchandise has been shipped. (d) Atina Auction House LLC in - house shipping does not ship International. All international buyers must hire their own shipper and/or delivery company for your merchandise. For USPS pick up from our warehouse we offer the packaging of your merchandise as a courtesy for a $10.00 handling fee that will be added to the purchase cost and applied to your invoice if you request in-house packaging for your merchandise. We do not combine lots into one package. Atina Auction house LLC will not be held liable for any broken, lost, stolen, or damaged merchandise packaged by us, or by USPS, or your shipper. Atina Auction House LLC may cancel in-house packaging for any reason at our sole discretion. In the event we cancel in-house packaging for your merchandise you will need to expedite delivery, packing, and shipping immediately upon receiving notification VIA Email by us. All merchandise must be paid in full before Atina Auction House LLC releases any purchased lot to the shipper. (e)Please allow for two (2) weeks for in-house shipped orders to be shipped. (e) All Merchandise pick up is by appointment only. The buyer should call us to schedule a time and day to pick your merchandise up from our warehouse which is in Livonia, Michigan 48125 anytime from 10 am - 6 pm MON - Friday unless another time is agreed upon by us including all merchandise pick up by shippers, movers, and delivery companies. All buyers who will be hiring their own shipper should start to make the necessary arrangements immediately proceeding the sale. Purchasers can find a list of shippers, shippers who pack merchandise, movers, and furniture delivery companies that we have provided solely as a courtesy to you at our website. Listed shippers we have provided should not be relied upon as ultimately it is your full responsibility in regard to hiring your own shipper and to meet the full terms and conditions set forth herein. Atina Auction House LLC, nor our staff, nor our seller will be held liable for anything that happens to your purchased items by any shipper, or in regards to in-house shipping, the buyer assumes all risks and liability for shipping, handling, and delivery.
